Welcome to Digi-Access platform (“Company”, “we”, “our”, “us”). These Terms & Conditions (“Terms”) govern your access and use of our website www.nfc.digi-access.com (the “Platform”) and the products and services we provide, including digital business cards and NFC-enabled solutions (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree, please do not use our Platform.

1. Definitions

User, You: Any person or entity using our Platform or Services.
Account: Your registered profile on the Platform.
Digital Business Card: The customizable profile you create and share.
Subscription: Paid or free plans that grant access to features.
NFC Products: Physical NFC-enabled cards or devices linked to the Platform.

2. Use of Services

2.1 Eligibility

You must be at least 16 years old to use our Services. By using the Platform, you confirm that you meet this requirement.

2.2 Account Registration

You must provide accurate and complete information.
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for all activities under your account.

2.3 Acceptable Use

You agree not to:

Use the Services for illegal, fraudulent, or harmful activities.
Upload or share offensive, misleading, or copyrighted content without permission.
Reverse-engineer, copy, modify, or exploit the Platform.
Interfere with the Platform's security or functionality.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions & Payments

3.1 Pricing

Subscription fees and product pricing are listed on the Platform. Prices may change with prior notice.

3.2 Billing & Renewals

Subscriptions may be billed monthly or annually depending upon agreed plan.
Subscription plans automatically renew unless cancelled before the renewal date.
By providing payment information, you authorize us or our payment processor to charge applicable fees.

3.3 Refunds & Replacement

Refunds are granted only in accordance with our Refund & Cancellation Policy. In general we only offer replacement policy wherein a faulty product can be replaced if that is due to manufacturer fault.

4. Digital Business Card Content

4.1 User-Generated Content

You may upload personal details, photos, links, and other information.

You retain ownership of your content, but grant us a worldwide, non-exclusive license to:

Store
Display
Transmit
Process
your content for the purpose of providing the Services.

4.2 Public Visibility

Any information you choose to display on your digital business card will be accessible to individuals with whom you share your card or who scan your NFC product.

You are responsible for the legality and accuracy of all content you publish.

5. NFC Products

If you purchase NFC-enabled cards or devices:

You are responsible for proper use and care.
NFC function compatibility may vary depending on the scanning device.
The Company is not responsible for third-party device limitations.

6. Intellectual Property

The Platform, design, software, trademarks, and content (excluding user-generated content) are owned by Digi-Access platform & Digital Access Solution Fz LLC.

You may not copy, distribute, modify, or create derivative works without our written permission.

7. Privacy Policy

By using the Platform, you acknowledge that you have read and agree to our Privacy Policy, which explains how your data is collected and used.

8. Termination

We may suspend or terminate your account at our discretion if:

You violate these Terms
You misuse the Platform
Required by law
Non-payment of subscription fees

Upon termination, your access to the Platform will cease. You may request deletion of your data in accordance with our Privacy Policy.

9. Disclaimers

The Services are provided “as is” without warranties of any kind.
We do not guarantee uninterrupted or error-free operation.
We are not liable for data loss due to factors beyond our control.

10. Limitation of Liability

To the fullest extent permitted by law:

We are not liable for indirect, incidental, or consequential damages.
Our maximum liability for any claim is limited to the total fees paid by you in the previous 12 months.

11. Third-Party Services

We may integrate with third-party tools such as payment processors, analytics services, or social media platforms. We are not responsible for their actions, policies, or service interruptions.

12. Governing Law

These Terms are governed by the laws of United Arab Emirates.

13. Amendments

We may update these Terms at any time. Changes become effective upon posting on the Platform. Continued use of the Services constitutes acceptance of updated Terms.
